Starting on January 1, 2024, the RCNY 103-15, a new regulation for parapet observations in New York City, will be in effect. This regulation applies to all buildings with parapets fronting the public right of way, regardless of height.
This regulation underscores the importance of annual parapet close physical examination to ensure that all its elements are structurally sound and adequately maintained to prevent accidents and comply with safety regulations. The parapet observation is required to be conducted by December 31, 2024, and subsequently on an annual basis by December 31 of each following year. Owners are obligated to maintain this report on file by December 31.
The only exceptions to the rule are the Detached 1- or 2-family homes or buildings with a fence or other barrier preventing access to the exterior wall.
Physical examinations of the parapets and their appurtenances (railings, antennas, fire escapes, flagpoles, cornices, etc.) can be performed from scaffolding or other observation platforms. Inspections conducted from fire escapes or roofs are also acceptable by the Department of Buildings.
The observation must determine if parapets are plumb by horizontal distance within one-eighth of their cross-section, evaluate safety measures, identify types of deterioration, and assess the stability of associated components. Any buildings with unsafe conditions must be promptly reported to the Department of Buildings. The owner is required to promptly implement public safety measures, which may include the erection of a sidewalk shed, elimination of the unsafe condition, enclosure of the area with a fence, and/or installation of safety netting. Additionally, the owner must take timely and appropriate steps to address and rectify the unsafe condition.
